Supreme Court Upholds Governor Adeleke’s victory

The election of Osun State Governor Ademola Adeleke has been upheld by the Supreme Court.
A five-member panel ruled on the appeal filed by the former governor Gboyega Oyetola on Tuesday, concluding that it lacked any form of merit.

According to the panel headed by Justice John Inyang Okoro, Oyetola and the APC failed to substantiate claims that voters in 744 polling places were not properly accredited by the BVAS, which resulted in excessive voting.

The panel also unanimously decided that the Osun electoral tribunal’s inability to take into account the preliminary objections made by Adeleke and the PDP at the trial level rendered the entire proceeding null and void.

Reading the lead judgment, Emmanuel Agim said that it is the record in the BVAS machines that can prove the number of accredited voters in a polling unit and nothing else and as the appellant could not prove the assertion in their petition, their case collapsed.

The Supreme court also held that Mr Oyetola and APC could not substantiate the claim of forgery leveled against Adeleke.

Adeleke was proclaimed the winner of the July election by the Independent National Electoral Commission (INEC) but displeased with the result, Mr Oyetola challenged the outcome of the poll.
