The Enugu State Electricity Regulatory Commission, EERC, says it will not reverse its decision to slash electricity tariffs for Band A customers from ₦209 to ₦160 per kilowatt-hour, starting August 1.

This follows a public notice from the National Electricity Regulatory Commission, NERC, questioning the state’s authority.

However, EERC insists it acted within the law, citing the 2023 Constitution amendment and Electricity Act, which empower states to regulate electricity distribution.

EERC also criticized NERC’s attempt to withhold federal electricity subsidies from states with independent markets, calling it unconstitutional and a misuse of power.

The state regulator maintains the tariff cut was based on a transparent and data-driven process, not populist sentiment.
