The Court of Appeal in Abuja has overturned a Federal High Court judgment that struck out a suit against the Central Bank of Nigeria (CBN) for refusing a Freedom of Information (FOI) request.
The suit, filed by Lawyers Network Against Corruption, sought records of demonetized coins as of March 2017 and July 2020. Justice Okon Abang ruled that under Section 21 of the FOI Act, applicants don’t need prior leave to seek judicial review of a public institution’s refusal.
The appellate court held that the Federal High Court erred in striking out the case, emphasizing the FOI Act’s intent to ensure swift access to justice. The case was referred for retrial.
