Mr Peter Obi has asked the Presidential Election Tribunal to determine that the President-elect, Mr Bola Tinubu of the All Progressives Congress, APC failed to score one quarter of the votes cast at the Presidential election in the Federal Capital territory , Abuja and therefore not qualified to be declared and returned as the winner of the Presidential election held on the 25th February,2023.
He also asked the court to void the presidential election on the ground that the election was not conducted substantially in accordance with the provisions of the Electoral Act 2022 and Constitution of the Federal Republic of Nigeria, 1999 as amended, accusing the Independent National Electoral Commission, INEC of breaching the law by failing to use electronic machines to upload polling station results as they stipulated.
He asked the court to cancel the election and mandate INEC to conduct a fresh election without the 2nd respondent Mr Bola Tinubu and the 3rd respondent his running mate Kashim Shettima.
In a petition signed by Dr Livy – Uzoukwu SAN and made available on Tuesday, he also sought the court to determine that the 2nd and 3rd respondents were not qualified to contest the election.
Recall that some electoral observers have already reported that the 2023 elections were marred with electoral violence , irregularities in different forms.
The Appeal Court has 180 days to hear and rule on Peter Obi’s challenge.
